In India, copyright law is primarily governed by the 'Copyright Act, 1957,' which has undergone several amendments to adapt to technological advancements and global standards.

Copyright is a set of exclusive rights granted to the creator of an original work. These rights include the right to reproduce, distribute, perform, communicate to the public, and modify the work. Unlike tangible property, copyright provides protection to intangible works—such as literary works, musical compositions, artistic creations, cinematic films, and sound recordings.

The fundamental principle underlying copyright law is to strike a balance between the interests of the creator and those of the public. While creators are rewarded for their efforts on the one hand, the public is, on the other hand, permitted to make limited use of such works, subject to certain exceptions.

Importance of Copyright Law

In academic contexts, such as LL.B. studies, understanding copyright law is essential for analyzing legal issues related to intellectual property, media, technology, and business. 

Copyright law plays a vital role in promoting creativity and innovation. It provides incentives to creators by ensuring financial rewards and recognition. At the same time, it supports cultural development and dissemination of knowledge.

Subject Matter of Copyright

Under the Copyright Act, 1957, copyright subsists in the following categories of works-

Literary Works – 

Books, articles, computer programs, databases.

Dramatic Works – 

Scripts, plays, choreography.

Musical Works – 

Musical compositions without lyrics.

Artistic Works – 

Paintings, sculptures, photographs, architecture.

Cinematograph Films – 

Movies and visual recordings.

Sound Recordings – 

Audio recordings of music or speech.
For a work to be protected, it must be original, meaning it should originate from the author and not be copied.

Ownership of Copyright

Generally, the author of a work is the first owner of copyright. However, Some exceptions are there-

  • In the case of employment, the employer may be the first owner.
  • For cinematographic films and sound recordings, the producer is usually the owner.
  • Government works belong to the government.
  • Works created under a contract may belong to the person who commissioned them, depending on the agreement.
  • Ownership can also be transferred through assignment or licensing.
  • Rights Conferred by Copyright
  • Copyright grants both economic rights and moral rights:
  • Economic Rights:
  • These allow the owner to commercially exploit the work, including:
  • Reproduction of the work
  • Distribution of copies
  • Public performance
  • Communication to the public
  • Adaptation and translation
  • Moral Rights:
  • These are personal rights of the author:
  • Right of paternity (claim authorship)
  • Right of integrity (prevent distortion or mutilation of the work)
  • These rights exist even after the transfer of economic rights.

Duration of Copyright

The duration of copyright protection varies depending on the type of work:

Literary, Dramatic, Musical, and Artistic Works: The lifetime of the author plus 60 years.
Cinematographic Films, Sound Recordings, Photographs: 60 years from the date of publication.
Government Works: 60 years from publication.
Upon the expiration of this period, the work enters the 'Public Domain,' where it may be freely used by anyone.

Infringement of Copyright

Copyright infringement occurs when a person uses a copyrighted work without permission in a manner that violates the rights of the owner. Common examples are-

  • Unauthorized copying or reproduction
  • Distribution of pirated copies
  • Public performance without license
  • Uploading copyrighted content online without permission

Remedies for Infringement

Civil Remedies-

  • Injunction (to stop infringement)
  • Damages or compensation
  • Account of profits

Criminal Remedies:

  • Imprisonment
  • Fine
  • Seizure of infringing copies

These remedies act as deterrents and help protect the rights of creators.

Exceptions and Limitations (Fair Dealing)

Copyright law also recognizes certain exceptions where the use of copyrighted material is permitted without authorization. This is known as fair dealing. Some examples are-

  • Private or personal use
  • Research and study
  • Criticism or review
  • Reporting of current events

Educational use
These exceptions ensure that copyright does not hinder freedom of expression and access to knowledge.

Copyright in the Digital Age

With the growth of the internet and digital technologies, copyright law faces new challenges. Issues such as online piracy, digital copying, and unauthorized streaming have become widespread. To address these, amendments to the law and international agreements like the TRIPS Agreement and WIPO treaties have been incorporated.
